Customs Seized HTC Gadgets in Germany over 3G Patent Row

February 25th, 2013

For HTC, the first week of February, 2013, was not as good as you people might have, as the products shipped, by the Taiwan based company, to Germany have been seized by the Customs Department at the Frankfurt-Hahn airport, Germany. This seizure has been reported as a result of an ongoing 3G patent battle between HTC and IPCom.

The reported incident came in light when the Taiwanese smartphone manufacturer HTC, in front of Judges in German Court for an ongoing trial on 3G patent infringement against IPCom, claimed that some of its products shipped between February 4 and February 10 to Germany were held by the customs at the Frankfurt-Hahn airport. However, HTC also stated that it isn’t short of its stock yet, and ample of handsets are still available in the German market.

When we investigated this matter further, we came to know this seizure took place soon after the German based patent regulation and monetization company IPCom applied for a warrant against HTC and its products claiming that they violate its patents, and asked the officials to hold the HTC’s 3G enabled smartphones at the border.

Additionally, when HTC reported this incident to the German Court, it also informed the court about another attempt that Munich-based IPCom made last year to have police seize its devices during CeBIT trade. The company stated that such actions from the IPCom are being made in an effort to make HTC succumb and accept its patent-licensing terms.

IPCom has a great history of suing firms for alleged portfolio of patented technologies that it bought from Robert Bosch GmbH, a former manufacturer of wireless mobile phones. A few years ago it sued both Nokia and HTC for the same as most of the patented technologies that its portfolio consists are related to the cellular telecommunications standards, which also includes the 3G technology.
